Terms and Conditions

    1. Information on how to enter form part of the terms and conditions of entry. By entering this competition, each entrant agrees to be bound by the terms and conditions including the terms of release the entrants must sign in connection with this competition in annexure “A” of the terms and conditions.

    2. The promoter is Microsoft Pty Limited, ACN 002 589 460 of 1 Epping Road, North Ryde, New South Wales, 2113.

    3. Entry is open to residents of Australia and New Zealand aged 18 years or over who hold a valid Australian or New Zealand drivers licence and who have not had such licence cancelled or been disqualified from driving in the past 5 years. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies, are not eligible to enter.

    4. The promoter reserves the right to verify the validity of entries including requiring verification of the age of the entrant and evidence of a current Australian or New Zealand drivers licence and to disqualify any entrant whom the promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these terms and conditions.

    5. The competition commences at 9:00am (Sydney time) on 18 August 2008 and closes at 5:00pm (Sydney time) on 26 September 2008. Only one entry per person permitted.  

    6. To enter, participants must: (i) purchase an Xbox Video Game System or bundle, or any Xbox 360 racing title, or any Official Xbox 360 accessory, or any Xbox 360 Live product from any retail outlet in Australia or New Zealand; and (ii) tell us in 25 words or less, what their greatest motorsport moment is and why? Entries must be submitted via the Xbox website (www.xbox.com.au/bathurst)using the approved form (with all details completed by the closing date and time.

    7. All valid entries received by the closing date will be reviewed by a judging panel appointed by the promoter. This is a game of skill. Chance plays no part in determining the winners. Each entry will be individually judged according to its originality and creativity.

    8. The competition comprises two parts. In the first part, the 7 most original and creative entries as judged by the judging panel will win a return trip from Sydney to Bathurst (Australia) leaving on 9 October 2008 and returning on 13 October 2008 via coach transfer. If entrants live outside Sydney, it is the responsibility of the entrant to arrange their travel to and from the coach transfer at Sydney at their own cost. At Bathurst, winner and 1 guest of each winner will receive 1 grand stand ticket each to the Supercheap Auto Bathurst 1000, 4 nights accommodation (twin share) at Tent City (camping accommodation), AUD$300 spending money for the winner, Grid walk for the winner and 1 spot for the winner in the Bathurst Xbox 360 Challenge.  Prizes are not exchangeable, transferable or redeemable for cash.  If the promoter is unable to supply the prize, the promoter reserves the right to supply another prize of greater or equal value.

    9. In the second part of the competition, the 7 finalists selected to participate in the first part of the competition (together with 5 other finalists who will be selected by any of the promoters’ media partners through other promotions) will have the opportunity to participate in a race against other finalists by driving an Xbox 360 Go Kart provided by the promoter for 1 lap around a purpose built track at Mount Panorama, Bathurst (the Bathurst Xbox 360 Challenge) on Friday 10 October 2008 at approximately 4pm. To be eligible to participate in the Bathurst Xbox 360 Challenge all 7 finalists must first participate in the Xbox 360 Go Kart driver training course conducted on Thursday 9 October 2008.
    The finalists with the three fastest times in the Bathurst Xbox 360 Challenge held on Friday 10 October 2008 will win:

    The total prize value for the second part of the competition is AUD$80,000.  Prizes are not exchangeable, transferable or redeemable for cash.  If the promoter is unable to supply the prize, the promoter reserves the right to supply another prize of greater or equal value.

    10. Entrants acknowledge that the second part of the competition involves a dangerous activity, including speed.  There is a risk that injury or death may result from participating in this part of the competition. By entering the competition the entrant acknowledges and agrees to release the promoter from responsibility for all liability which may result from the entrant participating in the second part of the competition. 

    11. The total maximum prize pool value is AUD$115,000. The stated prize value is the recommended retail price (inclusive of GST) in Australia as provided by the suppliers of the prizes and is correct as at 20 June, 2008. The promoter will not be responsible for any change in the value of a prize. The promoter and its associated agencies accept no responsibility for prizes damaged or lost in transit.

    12.  All entries become the property of the promoter. The promoter’s decision is final and no correspondence will be entered into.  No responsibility is accepted for entries by the promoter. Entries will be deemed void if stole, forged, mutilated or tampered with in any way.

    13. The valid entries in the first part of the competition will be judged at the promoter’s office at 10am on 29 September 2008 and all reasonable efforts will be made to notify the winner by email and/or phone by 30 September 2008. The promoter’s decision is final and no correspondence will be entered into.  Within 2 days of notification of being a winner each winner is required to provide the promoter with proof of purchase and a copy of a valid drivers licence (as referred to in clause 6) and the signed release referred to in clause 15.

    14. In the event that a prize is not claimed in both part 1 and part 2 of the competition the judges will select an alternate winner to receive the prize.

    15. Before the prizes are awarded to the winners, each winner will be required to sign the release in annexure “A” to the terms and conditions to release the promoter from and indemnify the promoter against, any and all liability arising from the use of or participation in any part of the competition including participation in the Bathurst Xbox 360 Challenge and driver training.

    16. That part of the prize comprising the tickets to the Supercheap Auto Bathurst 1000 are subject to the conditions of entry of Supercheap Auto Bathurst 1000 and the promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a result of the conduct of Supercheap Auto Bathurst 1000. 

    17. The coach transfer to and from and the accommodation in Bathurst may also be subject to conditions by the providers of the same. The promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a result of the conduct of the providers of such services.

    19. All meals, beverages, extra activities, additional spending money and all other ancillary costs (including travel insurance) not expressly provided for as part of a prize, are the responsibility of a winner and the winner’s guest. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

    20. All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant.

    21. Subject to any applicable law which cannot be excluded, the promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.

    22. The promoter assumes no responsibility for, and the entrant releases the promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.

    23. Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.

    24. Entrants consent to the promoter using the entrant's name and "25 words or less" entry should they be a winner, in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.

    25. Privacy Statement: Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion, entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the promoter’s privacy policy which is available at www.microsoft.com/australia/privacy. The promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
